COMMERCIAL DEBT COLLECTIONS:
As the economy struggles, many companies are not paying the accounts payable in a timely manner or are simply not paying at all. The Holloway Law Firm can assist your company in collecting those past due amounts, plus attorneys' fees and court costs if necessary.
Most businesses generally depend on clients to pay the invoices on time and if a business does not receive payment as anticipated, it could result in substantial harm to that business. Whether your company provides goods or services, is small or large, is incorporated or not, you need a strong collections attorney to make sure the accounts payable are paid. Some law firm collection efforts can be resolved by a short demand letter with a follow up phone call. Other efforts could require litigation to be initiated. The Holloway Law Firm generally attempts to resolve each collection matter by demand letter and follow up negotiations in order to keep costs lower; however, in some instances, litigation is necessary. In those instances, the client is provided with as much information related to possible costs so that the client can determine the economic feasibility of to litigate or not to litigate.
In the event the collection at issue is a secured obligation, we can draft and file the necessary documentation to repossess and/or foreclose on the collateral. In the event the debt obligation is unsecured, we will make every effort to negotiate payment in as timely a manner as possible and attempt to recover the maximum amount for the client.
Although many companies send unpaid debts to collection agencies for recovery, one should first investigate the actual costs of a collection agency as opposed to a collection law firm. Generally, a collection agency will charge a percentage fee for its efforts, successful or not. In the even a collection agency is not successful in it's collection efforts and the matter is then sent to a law firm for collection, additional charges are certain to arise. Whereas, a law firm can make the same demands for payment and can file suit to recover without the need to involve additional parties and increased cost. Anytime a company is determining whether or not to pursue a debt, it should examine the costs of each alternative method of collections and make an informed decision.
Should your company have a need for a Texas Collections Attorney or have questions related to commercial debt collection, please do not hesitate to call or email.
Please note that this firm does not handle personal collection matter and only provides collection and recovery services in a commercial or business context.
