MEDIATION

     The truth is that most litigants want to resolve their case without having to go through trial.  However, there are generally obstacles to prevent the amicable resolution of a contested issue.  If there weren't obstacles to resolution, there would be many fewer trials.  As a Mediator, my job is to act as a third party neutral to assist the parties in reaching a mutually agreeable solution to the issues at hand.  This is not always an easy task, but it is usually possible.

     One of the main advantages to resolving a case through mediation is the "Control Factor."  Basically, people want to be in control of their case; but going to trial puts twelve other people in control of the outcome of the case.  By working together to reach an agreeable solution, parties to a case retain the control of their case.

     Litigation is expensive; this is a fact.  By choosing to mediate a dispute the parties can curtail the additional expenses of preparing for and participating in a trial on the merits.

     Usually, a mediation session consists of a preliminary meeting which includes all parties and their respective attorneys along with the Mediator.  At this stage of the process, the Mediator will explain the process in general and request the attorneys to make their opening statements.  After the attorneys make their statements, I always offer the parties the opportunity to make a statement as well.  Not all mediators allow this level of participation in the process by the parties, but I feel that it is very beneficial to let each party personally tell the other party their position regarding the case.  It also gives each party a glimpse into the personal aspects of a case that may otherwise not be shown when only the attorneys are speaking.

     After the preliminary meeting, the parties are separated and the mediator will act as a "shuttle diplomat" and go back and forth between the parties to discuss the issues and assist the parties in reaching a resolution of the matters at hand.

     While the parties are in separate rooms, all information divulged to the mediator is held in confidence unless the divulging party gives the mediator permission to tell the other side what has been said.  Neither the mediator nor the mediator's records are subject to subpoena and the mediator cannot be required to testify as to the events of the mediation session.
